The Child Marriage Restraint Act 1929 is a Federal Law, which after 18Th Amendment, has become the provincial subject. In 2015, Punjab has amended the said law with higher penalties to the offenders.
According to the Child Marriage Restraint Act 1929 Punjab amendment 2015; the Minimum age of Marriage for Male is 18 years and 16 years for Female. If anyone, who violates this law, shall be punished with 06 months imprisonment and fine of Rs.50,000/- Further, who assists, helps or support the child marriage, even Parents, Guardian, Nikkah Khawan and Nikkah Registrars, shall be faced the same punishment, Six (06) Months imprisonment and fine of Rs.50,000/-
Punjab Government, Civil Society organizations and all stake holders have recommended to further amend the law for enhancing the girl minimum age of marriage 18 years rather 16 years. The matter is pending before the final opinion of Islamic Counsel of Ideology. It is pertinent to mention here that Sindh Province has enacted the law with minimum age of marriage 18 years for both male and female.
